Preparatory actions and documents
In order to perform a notarial act it is necessary to have with oneself:
1. 1. for an individual: an identity document (an identity card, a passport, a residence card) and a NIP number (a tax identification number); if the person acts as a proxy they should hold the power of attorney,
2. for a legal entity: in addition to the above a current extract from KRS (National Court Register) and a company act are needed.
Prior to performing a notarial act a notary public or an employee of the notary office should be contacted. It will allow to specify the scope of activities which are to be performed and the kind of documents which should be submitted in the office prior to the performance of a particular action.
All documents necessary for performing a notarial act should be delivered to the notary public earlier, i.e. before the agreed date of its performance. Their thorough analysis will allow for an efficient and safe performance of the act.
The documents should be submitted in the original version The notary public shall check their validity and evaluate whether they constitute a sufficient base for performing an act in order to safeguard due security of rights and proper interests of the parties of the notarial act, pursuant to art. 80 of the act dated 14 February 1991 on “Notarial Law”. Thorough preparation together with the compliance with the above rules guarantee that a planned act will meet customers’ expectations.
Originals of the following documents are necessary:
1.Transfer of real estate of a residential establishment or another type of an establishment:
* transfer base: a copy of a notarial deed and others;
* current extract from land and mortgage register (to be found in a District Court, Department of Land and Mortgage Register proper for the location of the real estate).

* in the case of a real estate acquisition by the means of an inheritance:
– court’s legally binding ruling about ascertainment of inheritance acquisition or an act of certifying the inheritance,
– a certificate of the Head of Tax Office issued pursuant to art. 19 par. 6 of the act on the taxation of inheritances and donations.
* in the case of a real estate acquisition by the means of a donation or a free-of-charge abolition of co-ownership made since 2007:
– a certificate of the Head of Tax Office issued pursuant to art. 19 par. 6 of the act on the taxation of inheritances and donations.
2. Transfer of a cooperative ownership right to a residential or another establishment:
* transfer base: a copy of a notarial deed or a certificate from a cooperative about this right, a contract of transforming a cooperative housing tenancy right into a cooperative ownership right to a residential establishment or into separate real estate and others,
* a valid copy of land and mortgage register, if it is carried out for this right (to be collected in a District Court, Department of Land and Mortgage Register respective for the location of the real estate).

* in the case of an acquisition of a cooperative ownership right to an establishment by the means of inheritance:
– court’s legally binding ruling about ascertainment of inheritance acquisition or an act of certifying the inheritance,
– a certificate of the Head of Tax Office issued pursuant to art. 19 par. 6 of the act on the taxation of inheritances and donations.
* in the case of an acquisition of a cooperative ownership right to an establishment by the means of a donation since 2007:
– a certificate of the Head of Tax Office issued pursuant to art. 19 par. 6 of the act on the taxation of inheritances and donations.
3. Transfer of real estate which is a developed or undeveloped plot of land:
* transfer base: a copy of a notarial deed or others,
* a valid extract from land and mortgage register, (to be collected in a District Court, Department of Land and Mortgage Register respective for the location of the real estate).

* A certificate from a District Office on land designation in the local spatial development plan or a certificate of its non-existence (for real estate situated on the territory of the District and Municipality of Środa Śląska: Urząd Gminy i Miasta Środa Śląska, 55-300 Środa Śląska, pl. In the case of the lack of the local spatial development – one should submit a planning permission or a building permit from the county office.

* final decision on the division of the real estate issued by a head of a district or a mayor of a town or a city,

4.Marital property settlement: an abridged copy of a marriage certificate.
5.Inheritance statement: an abridged copy of death inheritance and personal data of the remaining inheritors, birth certificates, marriage certificates, pesel number of the bequeather.
